13.5 Competition Animals. IRONPRIME AND ITS REPRESENTATIVES EXPRESSLY DISCLAIM ALL REPRESENTATIONS AND WARRANTIES IN REGARD TO THE SUITABILITY OR USE OF ANY PRODUCT FOR ANIMALS INVOLVED IN COMPETITION, INCLUDING AUTHORIZATION OR APPROVAL BY THE GOVERNING BODY FOR THE SPORT OR COMPETITION IN WHICH YOUR ANIMAL IS INVOLVED. IRONPRIME LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE) OR OTHERWISE ARISING OUT OF OR RELATING IN ANY MANNER TO THE USE OF ANY PRODUCT FOR AN ANIMAL ENGAGED IN ANY COMPETITION SHALL BE THE TOTAL AMOUNT PAID BY YOU FOR THE PRODUCT.


14. Limitation of Liability.

NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY OF ANY KIND, NEITHER IRONPRIME NOR ANY OF ITS REPRESENTATIVES ARE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES OR LIABILITIES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY MANNER TO THE CONTENT, SERVICES AND/OR ANY LINKED WEBSITE OR APPLICATION, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR LIABILITIES. You agree to fully indemnify, defend and hold IronPrime and its Representatives from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees) and other expenses that arise directly or indirectly out of or from (a) your breach of these Terms of Service, (b) any allegation that any Ideas or other materials you submit to us or transmit to a IronPrime website or application infringe or otherwise violate the copyright, patent, trademark, trade secret or other intellectual property or other rights of any third party, and/or (c) your activities in connection with the Site.


16. Jurisdiction.

IronPrime websites and applications are administered by IronPrime from its offices in Miami, U.S.A. and other locations within the United States. IronPrime makes no representation that the Site is appropriate or available for use outside the United States, and access to the Site from jurisdictions in which the contents of the Site are illegal is prohibited. You may not use, export or re-export the Site or any copy or adaptation thereof, in violation of any applicable laws or regulations, including without limitation U.S. export laws and regulations. If you choose to access this Site from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws. These Terms of Service shall be governed by the laws of the State of Maine without regard to its conflict of law provisions. EACH OF THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY LITIGATION (INCLUDING BUT NOT LIMITED TO ANY CLAIMS, COUNTERCLAIMS, CROSS- CLAIMS, OR THIRD PARTY CLAIMS) ARISING OUT OF, UNDER OR IN CONNECTION WITH THESE TERMS OF SERVICE. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO these Terms of Service. The failure of IronPrime to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or these Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred. 17. Arbitration.

At our or your election, all disputes, claims, or controversies arising out of or relating to these Terms of Service and/or the Site that are not resolved by mutual agreement may be resolved by binding arbitration to be conducted before J.A.M.S. or its successor. IronPrime shall advance the costs of such binding arbitration, but you agree that should we prevail in the arbitration, IronPrime is entitled to reimbursement of all costs. Unless otherwise agreed by the parties, arbitration will be held in Miami, before a single arbitrator mutually agreed upon by the parties, or if the parties cannot mutually agree, a single arbitrator appointed by J.A.M.S. and will be conducted in accordance with the rules and regulations promulgated by J.A.M.S. unless specifically modified in these Terms of Service. The arbitration must commence within forty-five (45) days of the date on which a written demand for arbitration is filed by either party. The arbitrator will have the power to order the production of documents by each party and any third-party witnesses. In addition, each party may take up to three (3) depositions as of right, and the arbitrator will not have the power to order the answering of interrogatories or the responses to requests for admission or the inspection of premises. In connection with any arbitration, each party must provide to the other, no later than ten (10) business days before the date of the arbitration, the identity of all persons that may testify at the arbitration, a copy of all documents that may be introduced at the arbitration or considered or used by a party’s witness or expert, and a summary of the expert’s opinions and the basis for said opinions. The arbitrator’s decision and award shall be made and delivered within sixty (60) days of the conclusion of the arbitration and within six (6) months of the selection of the arbitrator. The provisions of this arbitration section will be enforceable in any court of competent jurisdiction.

RETURN POLICY

Exchanges & Returns for Individuals

IronPrime offers free returns and exchanges within 30 days of purchase to ensure that individuals obtain the correct product in good condition. Only products that have not been worn past the fitting stage, have not been customized and are in their original packaging will be accepted. Contact us weekdays from 9:00 a.m. to 5:00 p.m. EST, except on holidays, at (432) 523-3877.

For Defective Exchanges or Returns:

  • If you have an issue with product workmanship within 30 days, please contact us immediately at (432) 523-3877.We will provide you with an RMA authorization number. Defective exchanges or returns must be received by IronPrime within 15 business days of the RMA authorization number issuance. No defective exchanges or returns will be accepted without an RMA authorization number.

Exchange and refunds on returns will be issued within two business days of IronPrime receiving the original product under the conditions stated above. Replacement shipping is provided free via DHL or Hermes. If you require expedited shipping, it must be paid in full in advance of shipment.

These policies do not apply to international orders. Please contact BioPatch for information.

Please make sure you follow the above policies for prompt resolution. If these policies are not met, IronPrime may refuse your shipment; you will be notified, and the product may be returned to you at your expense.


Warranty

IronPrime wants you to be satisfied with your purchase from us. All patches are guaranteed against any defect in materials or workmanship for 30 days from the date of purchase, unless altered or laundered incorrectly (see product insert for instructions).


Right of return

For this refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you.

Once your return has been received and verified, we will send you an email to notify you that we have received your return. We will also notify you of the approval or rejection of your refund. If your request is approved, your refund will be processed and a credit will automatically be applied to your credit card or original payment method within a specified time period.

Refunds with PayPal and Klarna can take 1 business day and 4-7 business days for credit/debit card payments.

Late or missing refunds (if applicable).

If you have not yet received a refund, first check your bank account again. Then contact your credit card company. It may take some time before your refund is officially posted. Then contact your bank. There is often processing time before a refund is posted.
